If you are buyingAs the prices for second-hand vehicles are higher in Spain than in many European countries, don’t be caught by a very cheap price offered – there may be a catch.
Before committing yourself, you can ask in Trafico for a document called “Informe”. It will tell you if the vehicle has any problems/fines attached to it, and who is the current official owner. Confirm that the person selling you the vehicle is the owner, or at least has the necessary documents from the official owner. You should be given the originals of the following documents:
•Permiso de circulacion – car registration document
•Ficha technica – ITV document
•Payment confirmation of the current road tax
You will also need copy of the passport and NIE/Residencia document of the official owner.
If you are selling
As the seller, you have to make sure that the transfer is done. Otherwise any future fines and road taxes will all be in your name, and you will be liable for them.
Keep the contact details of the buyer, just in case.
The process
The contract of sale/purchase should be created and signed by both sides for their own interests. This can be obtained in any lawyer’s office, gestoria or official Tobacco shops.
The transfer process should be started as soon as possible. All documents have to be taken to Trafico together with the payment of trafico and transfer taxes. Trafico tax is fixed, and transfer tax is 4% of the value of the vehicle, estimated by the Tax Office (Hacienda) tables.
The process on average takes from two to three weeks and can be done with any gestoria or other service companies.
